COPYRIGHT UNDER THE COPYRIGHT ACT 1957 :

In India, Copyrights are protected under Copyright Act, 1957. Copyright is a bundle of rights given by the law to the creators of literary, dramatic, musical and artistic works and the producers of cinematographic films and sound recordings.

Copyright Registration enables author & owner to file a suit under Civil Procedure Code and also complaint under criminal procedure code against the person for the copyright infringement.

Copyright Registration

Copyright registration is not mandatory. However, Certificate of Registration of copyright and the entries made therein serve as prima facie evidence in a court of law with reference to dispute relating to ownership of copyright.

1. Cover letter of Lawyer.

2. Acknowledgment in Triplicate (Will be received & delivered from our end after online filing).

3. Signed Form XIV, Statement of Particulars, Statement of further particulars in Triplicate. (Will be received & delivered from our end after online filing)

4. Copy of Work in Triplicate. (Copy of literary work i.e. Book)

5. POA (Form of Authorization executed on INR 100/- Stamp paper)

6. NOC of Author/Composer/Owner/Artist/Producer in favour of Owner if required.

8. Search Certificate from TMR in case of Artistic/Literary work is used in relation of goods/services.

Currently in India, Copyright office is operating from New Delhi.

Duration For Copyright Registration

1) Copyright filing- 4-5 working days.

2) Copyright registration- Approx 12 Months.

3) After receiving registration certificate one can use Ⓒ symbol on its works.
